Vascular Solutions Inc. (VASC) said Wednesday a jury found that the company contributed to and induced infringement of a patent held by Diomed Inc. (DIO), and awarded Diomed $4.1 million in damages.
The case related to Vascular Solutions' Vari-Lase products for the treatment of varicose veins, and the jury didn't find willful infringement.
Minneapolis-based Vascular Solutions plans to appeal the verdict, and that it expects Diomed to request an injunction on the U.S. sale of Vari-Lase products.
The company has prepared for the possibility of an injunction by developing a new version of its Vari-Lase fiber.
"Therefore, even if Diomed requests and receives an injunction against future sales of our bare tip Vari-Lase products, we expect to already have transitioned to a non-infringing alternative without disruption in meeting our customers' endovenous laser therapy requirements," said Vascular Solutions Chief Executive Howard Root in a statement.
Vascular Solutions shares fell 3.8% to $10.23 in Wednesday afternoon trade, while Diomed shares were halted at $1.46, up 33%.
