Navistar International Corporation (NIC) is a holding company, whose principal operating subsidiaries are Navistar, Inc. and Navistar Financial Corporation (NFC). The Company is a manufacturer of International brand commercial and military trucks, IC Bus (IC) brand buses, MaxxForce brand diesel engines, Workhorse Custom Chassis (WCC) brand chassis for motor homes and step vans, and Monaco RV (Monaco) recreational vehicles (RV), as well as a provider of service parts for all makes of trucks and trailers. In addition, it is a private-label designer and manufacturer of diesel engines for the pickup truck, van and sport utility vehicle (SUV) markets. It also provides retail, wholesale, and lease financing of trucks and parts. NIC operates in four segments: Truck, Engine, Parts and Financial Services.

US Court Tosses EPA Diesel Engine Rule That Helped Navistar

WASHINGTON--A federal appeals court on Tuesday vacated an Environmental Protection Agency rule that would have allowed Navistar International Corp. (NAV) to sell heavy-duty diesel truck engines that fail to meet the latest pollution standards for engine exhaust.

The U.S. Court of Appeals for the District of Columbia Circuit ruled the EPA did not have good cause to issue an interim regulation in January that would have allowed Navistar to pay fines in order to continue to sell the noncompliant engines.

The court said Navistar's business plight was not a proper justification for the EPA to issue the rule without following normal administrative procedures.

"The rule does not stave off any imminent threat to the environment or safety or national security," Judge Janice Rogers Brown wrote for the court. "It does not remedy any real emergency at all, save the 'emergency' facing Navistar's bottom line."

Tuesday's ruling was a win for Navistar's competitors, which filed lawsuits challenging the EPA rule. Cummins Inc. (CMI), and units of Volvo AB (VOLVYVOLV-B.SK) and Daimler AG (DDAIYDAI.XE) said they invested hundreds of millions of dollars to make engines complaint with the EPA standard. They argued the EPA rule provided an unfair assist to a competitor that didn't make the same efforts.

The case is Mack Trucks Inc. v. EPA, 12-1077.

i peaced out when i saw premarket was up 3 percent.  took a bit of a hit but thats the way she goes. i was surprised to see it up another 8 percent today for sure
